1. Could you please introduce yourself?


I am Deepal Fernando Mechanical Engineer by profession; Graduated from Belorussian Polytechnic Institute in 1977. Worked for 20 years for the government of Sri Lanka and 17.5 years as Senior Procurement Specialist of the World Bank. Worked in many countries including Azerbaijan as International Procurement Specialist in Baku for four years. Since retirement I have worked as an International Consultant to ADB and several consulting firms.



2. You will be discussing developing the best practice procurement strategy on March 04 at the Baku Supply Chain Forum. What would you like to comment on this?


IFIs have been supporting development projects may be infrastructure or social sectors all over the world after the second World War II Projects are implemented by the borrower governments following Guidelines/Regulations of the IFIs based on Public Procurement Principles. Timely completion of projects has been an issue. Almost all the projects have been extended and most of the civil works contracts have never been completed in a timely manner within the initial estimated costs and sometimes the expected quality. In early 2010 The World Bank took the lead in consulting the borrowers to get their views on the reasons for delayed project implementation and how to improve this situation. IFIs prepared a new framework for procurement which included that a Procurement strategy has to be developed during project preparation. The borrowers are responsible for preparing the strategy. The main focus is to consider the market situation in the borrower country with regard to project implementation. The borrowers shall carry out a PESTLE analysis, ( Political, Economic,Social, Technological,Legal and Environmental )aspects and their effect on the procurement approach to be considered preparing a procurement plan for a specific project. The above factors will enable us to consider risks and prepare mitigation plans at the beginning for better project implementation.



3. Are you familiar with the public procurement regulations of Azerbaijan? Could you please make comparative analysis of these regulations of other countries?


Since gaining independence Azerbaijan prepared a Public Procurement Law based on UNCITRAL model law in 2001 and it has undergone many revisions for improvement. Even now the Law is being revised to bring it inline with international best practices. I am in the consultant's team to support preparation : (i) the Law; and (ii) standard bidding documents and user guides based on the new law and working with the Procurement Department of the State Service for Anti Monopoly and Consumer Market Control (SSACMC). Procurement Reforms all over the world are done at slow pace and always there is room for improvement based on the country context.



4. In your opinion, what is the role of public entities and companies in increasing transparency in Procurement?



Both Public and Private sector procurement will consider value for money as an important factor. However in the Private Sector the red tape is much less and decision making may be vested in one or two to look after the best interest of the investors. The approach of public entities are different as they have Laws and Rules to follow. Decision making is slower. However transparency and fairness are two major factors I would consider in public procurement. It is important to build confidence among the potential bidders that entities are fair and transparent. Even if they do not win a tender, they are confident that the agency carries out a fair and reasonable assessment of the procurement. That can be achieved by (i) Preparation of bidding documents based on Standard Documents (Bidders will spend less time in studying the documents); Goods: prepare unbiased technical specification based on the needs following a good market analysis to widen competition; (iii) Civilworks: Prepare designs and bills of quantities following good site investigations and any social and environmental factors contributing to delays during contract execution. Also good designs based on realistic scope of works and Bill of Quantities shall minimize variations due to quantity variations and modifications to scope and final cost within the estimate; (iv) Advanced notice of procurement opportunities (publication of procurement plans); (v) Reasonable time for preparation of bids; (vi) Public Opening of Bids; (vii)bid evaluation based on the disclosed criteria without referring to extrinsic evidence; (viii) award to the most advantageous bid .
